While we strive to deliver excellent results, we cannot guarantee specific outcomes such as:

• Specific revenue increases or ROI
• Exact email deliverability rates
• Particular engagement metrics
• Results within specific timeframes

Our services are provided "as is" and we disclaim all warranties, express or implied, to the fullest extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by law, No Ifs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

9. Termination

Either party may terminate services with written notice as specified in individual service agreements. Upon termination:

• All outstanding payments become immediately due
• We will provide a transition period for ongoing campaigns
• Client data will be returned or destroyed as requested
• Confidentiality obligations continue to apply

10. Data Protection and Privacy

We are committed to protecting your data in accordance with applicable privacy laws. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

11. Compliance with Laws

All email marketing activities must comply with applicable laws including but not limited to:

• CAN-SPAM Act (United States)
• GDPR (European Union)
• CASL (Canada)
• Other relevant data protection and anti-spam legislation

12. Dispute Resolution

Any disputes arising from these Terms of Service or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Florida, United States.
